Terms and Conditions for the Placement of a Nanny or Maternity Nurse

These terms constitute the contract between CMC (the Agency) and the Client. Upon confirming the engagement of a nanny/maternity nurse (the Candidate) after introduction by the Agency, the Client agrees to enter into and accept the terms of this Contract.

  • The agency makes no guarantee, express or implied, as to the suitability of the candidate to the client. The client is advised to meet the nanny/maternity nurse themselves and do a full reference check before confirming the booking.
  • When placing a nanny the agency will check references provided by the nanny for the last three years to enquire about her/his most recent history only. Where the nanny has worked in a single position longer than the last three years, further references will be checked.
  • When placing a nanny the agency offers a six week settling in period for British placements, and ten weeks for overseas placements, wherein if either party is unhappy the agency will do its best to rectify any problems.
  • The agency further provides a replacement offer; where required it will find a suitable replacement within the six  or ten weeks at no further charge. However, suitable replacements cannot be guaranteed and no refunds are issued.
  • For maternity nurse bookings, the agency is not responsible for organising any deposit between the client and the candidate.
  • For permanent placements the introduction fee will be due and payable once contracts have been signed by both parties. Contracts must be signed prior to the starting date.
  • It is the responsibility of the client to facilitate the contract with the permanent candidate. The agency bears no responsibility but may offer advice or guidance as required.
  • When hiring a full-time or permanent nanny, the client/employer is responsible for and accountable to register with the Inland Revenue and pay required tax and national insurance on top of the candidate’s net salary. The agency is not responsible for any tax related issues.
  • All maternity nurses are self-employed, therefore all monies paid by the client/employer are gross payments and the client is not responsible for paying the candidate’s tax and national insurance.
  • The agency recommends clients use a service such as Nanny Tax to take care of the complete financial process, refer to www.nannytax.co.uk.
  • For permanent positions, in the event the nanny’s salary is raised within the first 6 months of placement, the client is liable to pay the difference in agency fees.
  • If a candidate fails to commit to a booking, the agency will offer a suitable replacement to the client, providing the placement fee has been made.
  • If the candidate decides to leave the position due to untenable circumstances the agency will not issue a refund.
  • If the client cancels a booking the agency reserves the right to hold 25% of the fee for work carried out.
  • If the booking is extended, or the candidate returns to the client at a future date, the client must inform the agency and a new invoice will be issued.
  • The client may be requested to pay a 50% retainer fee for the candidate, however this is up to the discretion of the candidate.
  • All communication, whether written or oral, shall be confidential between both parties. Should the client pass on any information including any details of candidates, or recommend a candidate to a third party resulting in a booking of permanent, temporary or part time childcare employment then the client will be liable for the relevant full fee as if the booking had been made by the client itself and these terms and conditions shall apply accordingly.
  • In the rare occasion, the agency reserves the right to cancel bookings at last minute if unforeseen circumstances may occur, but an alternative will be agreed by both client and agency. If a suitable replacement may not be found, the agency will offer a full refund.
  • Incorrect invoices must be queried within 30 days from the invoice date. Refunds will not be given after this period.
  • CMC Agency will not be held responsible for any loss or damage incurred directly or indirectly as a result of an act or omission by any Child Carer introduced by the Agency.

 

Further Terms and Conditions for the Placement of a Temporary Nanny

  • If the placement fee is not paid in full before the candidate commences, the agency reserves the right to allocate the candidate with another booking whether or not a deposit has been paid to the agency.
  • For temporary placements the introduction fee will be invoiced upon confirmation of the start date.
  • Temporary nannies are booked on a weekly calendar (Monday to Sunday) basis at the prevailing rate.


Terms and Conditions for Troubleshooting and Other Services

These terms constitute the contract between CMC (the Agency) and the Client. Upon confirming the engagement of a sleep trainer or other consultant after introduction by the Agency, the Client agrees to enter into and accept the terms of this Contract.

  • Email and phone consults, weaning and potty training advice are all paid in advance.
  • For consulting bookings,  dates are only guaranteed when payment is received.
  • No refunds will be issued for any cancellations made less than 7 days prior to a booking. If an illness prevents a booking, it is at the discretion of the consultant if the dates can be changed, but changes will always be made where possible.
  • Carol may not be available for all troubleshoots and can be replaced by other troubleshooters that she has personally trained with her own methods.
  • On rare occasions the agency reserves the right to cancel bookings at last minute if unforeseen circumstances may occur, but an alternative date will be agreed by both client and agency.
  • Whatsapp service is available from 730 am to 930pm and is available 7 days per week but not all messages will be responded to immediately, it may take up to 1hr.
  • A 2 hr break will be taken during each 24 hr period by the consultant at a convenient time for both client and consultant.
